DHS Revises I-9 Rule and Form

December 17, 2008

The Department of Homeland Security today published revisions to the I-9 Rule and the I-9 Form. According to DHS,

“The Department of Homeland Security (DHS) is amending its regulations governing the types of acceptable identity and employment authorization documents and receipts that employees may present to their employers for completion of the Form I–9, Employment Eligibility Verification. Under this interim rule, employers will no longer be able to accept expired documents to verify employment authorization on the Form I–9. This rule also . . . makes several technical corrections and updates. . . A copy of the amended Form I–9 reflecting these and other form-related changes is being published as an attachment to this rule.”

Expired documents that are no longer acceptable for I-9 purposes include expired US passports and expired state-issued driver’s licenses.
