National Immgration Law Center Reports Actual Experience with E-Verify at Odds with DHS Estimates

The National Immigration Law Center (NILC) recently reported statistics that cast doubt on Department of Homeland Security’s claims regarding the accuracy and ease of use of the DHS’s E-Verify system for verifying whether a prospective employee is legally authorized to work in the United States. According to the NILC:

  • DHS claims that only 0.5% of work authorized employees receive a “tentative nonconfirmation” (TNC), which means that they cannot work unless and until they clear up the problem. However, a sampling of employers indicates that the actual percentage ranges from 12% to 15%.
  • DHS estimates that it takes 8 hours on average to resolve a TNC with the Social Security Administration, but actual experience is that corrections at SSA usually take in excess of 90 days and workers must wait 4 or more hours per trip with repeated trips to SSA.
