FBI Issues Proposed Rule to Increase Name Check Fees

The FBI today issued a proposed rule to establish a fee for providing fingerprint-based and name-based criminal history record information. According to the FBI, the fees would be used to cover the FBI’s expenses and administrative costs associated with providing this information for non-criminal justice (i.e., immigration and federal employment) purposes.
Currently, foreign nationals must undergo FBI security clearances to obtain immigration benefits such as nonimmigrant visas, permanent residence, and citizenship. The new rule would establish a modest fee for the name and fingerprint based checks, and higher fees for individualized analysis and expedite requests. The U.S. Citizenship and Immigration Service has not announced whether these fees will result in an increase in USCIS fees for related immigration benefit applications.
