The Department of Defense, General Services Administration, and NASA today published their joint agreement to delay the effective and applicability dates for their rule requiring federal contractors to participate in the U.S. Citizenship and Immigration Service
E-Verify program for verifying the employment eligibility of their employees.  

The delay to February 20, 2009 is the result of an interim negotiation between the parties in a lawsuit filed by the U.S. Chamber of Commerce and others challenging the legal basis for requiring participation in the E-Verify program.  For a summary of the E-Verify program and the new rule, please see our November 14, 2008 article entitled, "New Federal Rule To Require Use of E-Verify System for Certain Federal Contractors and Subcontractors."  Click Here.
